US Applicant Privacy Notice
Gavin de Becker & Associates (“GDBA”) collects the following categories of personal information to evaluate your candidacy, conduct background checks, communicate with you, and comply with legal record keeping requirements: Identifiers (e.g., name, contact details, online identifiers, and, where legally required, Social Security number); professional or employment-related information (e.g., resume, employment history); education and credential information; and, only at the appropriate stage of the hiring process and as permitted by applicable law, sensitive personal health and safety information such as vaccine status, results from occupational health screenings, criminal conviction history or license verification information; collectively (the “Applicant Data”).
Purpose: We use Applicant Data solely for GDBA’s business purposes, including but not limited to: assessing your suitability for the role; communicating with you during the hiring process; satisfying any legal, accounting, or reporting standards or obligations; to ensure a safe workplace in compliance with the law and client-site requirements regarding health and vaccination status; and to verify your identity and to conduct background checks as permitted by law.
Data Sharing: We do not “sell” or “share” Applicant Data for cross-context behavioral advertising purposes. However, Applicant Data may be used, shared, or stored with our vetted third party vendors for the purposes described herein. Applicant Data is retained only for as long as reasonably necessary to administer the recruitment process, comply with record-keeping and equal employment obligations, resolve disputes, and enforce legal rights. Application records for non-hires are retained only for as long as reasonably necessary to fulfill the purposes for which they were collected. GDBA does not retain any biometric data obtained throughout the application process for non-hires.
Jurisdictional Variances: Your privacy rights vary by jurisdiction. California residents have rights under the California Consumer Privacy Act, as amended by the CPRA, including the right to access, correct, or delete certain personal information, subject to legal exceptions. Requests may be submitted to investigations@gdba.com. Your choice in exercising applicable privacy rights will not, by itself, adversely affect your application.
Nature of Discussions: You understand that, unless otherwise indicated by GDBA in writing, all discussions during the application and interview process are not confidential, interviews and prompts are solely intended to assess your qualifications for employment. You should not disclose information that you are legally prohibited from sharing, including third-party trade secrets or information protected by confidentiality obligations. GDBA does not request and does not require applicants to disclose protected health information, genetic information, or other information prohibited by federal, state, or local law. Any such disclosure may result in immediate termination of the application process.
Consent for Recording: Recording will occur only where permitted by applicable law and with the consent required in the jurisdiction where you are located.
